CODE FITNESS CLIENT AGREEMENT

PLEASE PAY CAREFUL ATTENTION TO THIS DOCUMENT AS IT SETS OUT THE TERMS UNDER WHICH YOU CAN USE THE GYM AND OTHER FACILITIES AT CODE FITNESS BETWEEN CODE FITNESS LIMITED (‘Code Fitness’) and the CLIENT

Code Fitness and the Client agree to the following terms:

  1. The Client shall be entitled to use all facilities at Code Fitness premises, subject to any specific terms relating to the use of those facilities (e.g. any requirement to seek medical advice before using and any extra fees payable) including behaving appropriately on Code Fitness premises.
     
  2.  This contract shall last for 6 calendar months and will, thereafter, continue for further periods of 1 month unless terminated
     
  3. The Client will pay Code Fitness the fees for use of the facilities monthly in advance at the rates notified from time to time to the Client by Code Fitness. Any change of rates shall take effect in the 3 month period following the period in which the change shall occur.
     
  4. If the Client books a specific service then full payment must be made in advance and no refund will be made unless a minimum of 24 hours’ notice of cancellation is given.
     
  5. The contract may be terminated: 5.1 by the Client on giving Code Fitness 1 month’s written notice (e-mail accepted), after the initial 6-month contract. 5.2 by Code Fitness on 1 month’s written notice or immediately if the Client shall have committed a serious breach of the terms of this contract. ‘Serious breach’ includes failure to make any payment under clause 3 or a service booked under clause 4; or for failure to comply with clauses 6, 7, 8, 9 and 10; or inappropriate behaviour to other Clients, visitors or staff at Code Fitness premises.
     
  6. ​​The Client agrees to comply with the Code Fitness Health and Safety Policy attached. 
     
  7. The Client acknowledges and accepts that Code Fitness does not under any circumstances, diagnose, prescribe or treat any illness, symptoms of illness or medical problems and the Client confirms that any such diagnosis, treatment or prescription (including nutritional advice) must be sought and obtained from the appropriate medical professional.
     
  8. The Client acknowledges and accepts that s/he has read and understood the information attached relating to Nutritional and Herbal supplements and confirms that s/he accepts that the advice that Code Fitness may offer on supplements, nutrition, training, emotional well-being and physiology is advice only and should under no circumstance be deemed as prescriptive. The Client agrees to keep her/his healthcare professionals fully informed as to any supplements and training regimes undertaken and to inform Code Fitness of any advice or recommendation given to the Client by that medical professional.
     
  9. Code Fitness requires that the Client complete the Physical Activity Questionnaire attached prior to use of Code Fitness facilities and the Client confirms that s/he will notify Code Fitness as soon as practicable should any of the answers to the questions in the Physical Activity Questionnaire change or if a medical professional gives the Client any advice or makes any recommendations relating to physical training. Code Fitness strongly recommends that the Client seek the advice of an appropriate medical professional before undertaking any physical training.
     
  10. The Client will use all equipment and facilities in accordance with the advice Code Fitness gives to the Client and, even if used without advice, in compliance with the instructions for use of such equipment and facilities. The Client accepts that use of equipment and facilities is entirely at her/his risk and agrees that s/he will not hold Code Fitness liable for any injury sustained by her/his mis-use or failure to follow advice given. 
     
  11. Unless otherwise agreed to in writing by Code Fitness, the Actor/Subject will receive no compensation for the Projects. This Agreement constitutes the entire agreement by and between the Actor/Subject and Code Fitness and supersedes any and all prior contracts, understandings, negotiations, and agreements with respect to the Production Company and the subject matter hereof, whether oral or written.
     
  12. The actor agreement is entered into by and between the named person on this signed contract (the “Actor/Subject”) and Code Fitness (the “Production Company”). The Actor hereby grants to the Production Company and to its licensees, assignees, and other successors-in-interest, all rights of every kind and character, in perpetuity, in and to the Actor’s performance, appearance, likeness, name and/ or voice (the “Performance”) in connection with the Promotion of Code Fitness Projects.

The Client hereby authorises Code Fitness to photograph, videotape, film and record (on film, tape, or any other medium), the Performance and audition(s) for the Performance; to edit the same at its discretion and to include it with the performances of others and with sound effects, special effects, digital effects and music; to incorporate the same into the Picture, trailers, posters or other materials or programs related to the Projects; to use and to license others to use such records and photographs in any manner or media whatsoever, including without limitation unrestricted use for purposes of publicity, advertising and sales promotion; and to use my name, likeness, voice, biography or other information concerning me in connection with the Picture and for any other purpose associated with the Project. The Actor further acknowledges that Code

Fitness owns all rights to the Projects.

This Agreement is governed by, and shall be construed in accordance with English Law.

HEALTH & SAFETY

CODE FITNESS considers the management of safety as a priority and is committed to meeting all its Health and Safety obligations. It cares for the Health and Safety of its Clients and staff and any other visitors to its premises

IT IS THE DUTY OF EVERY CLIENT TO:

  • Conduct themselves in a safe and healthy manner so as not to expose themselves, any other Client, member of staff or any visitor to risk at all
  • Co-operate with management, staff and other Clients so as to enable the discharge of all duties under the Health and Safety at Work Act 1974 (which shall include any subsequent statutory rules and regulations governing health and safety at work)
  • Report without delay all risks or hazards, including defects to machinery, unsafe practices and ‘near miss’ situations directly to a member of Code Fitness staff
  • Take reasonable care of themselves and other persons who may be affected by their acts or omissions while on Code Fitness premises

PERSONAL HEALTH AND SAFETY

  • If any Client sees anything that may cause an accident – for example (but this is not a comprehensive list) spilt liquid, a trailing cable, broken glass, litter, a damaged floor – then that Client must report it to a member of Code Fitness staff as soon as practicable.
  • It is strictly forbidden to bring alcohol or drugs onto Code Fitness premises save for prescription or ‘over the counter’ drugs, which may be brought onto the premises only after having been reported to a member of Code Fitness staff before entering. If required the Client must hand over the drugs to Code Fitness for safekeeping.  It is strictly forbidden to consume either alcohol or drugs on Code Fitness premises, except prescription or over the counter drugs that have been reported and which can only be consumed in strict accordance with the instructions for such consumption.
  • It is strictly forbidden to enter Code Fitness premises under the influence of alcohol or drugs. Any Client found to be so will be prohibited from using the gym equipment and may be required to leave the premises immediately.

NUTRITIONAL AND HERBAL SUPPLEMENTS

Technically, vitamins, minerals, trace elements, amino acids, herbs, or homeopathic remedies are not classified as drugs. However, these substances can have significant effects on physiology and must be used judiciously. 

At Code Fitness, we provide nutritional coaching and make individualized recommendations regarding use of these substances in order to upgrade the quality of foods in our Clients’ diet and to supply nutrition to support the physiological and biomechanical processes of the human body. Although these products may also be suggested with a specific therapeutic purpose in mind, their use is chiefly designed to support given aspects of metabolic function. Use of nutritional supplements may be safely recommended for patients already using pharmaceutical medications (drugs), but some potentially harmful interactions may occur. 

It is imperative that our Clients keep all of their healthcare providers fully informed about all medications, nutritional supplements and herbs that you may be taking and of the advice given in respect thereof. Use of nutritional and herbal supplements is entirely at the Client’s risk and Code Fitness gives no warranties in respect of such use.
